1 Interpretation In these Conditions:

• 'BUYER' or 'YOU' means the person who accepts a quotation of the Seller for the sale of the 'Goods' and whose acceptance is then confirmed by the Seller in accordance with these conditions or whose order for the 'Goods' is accepted by the seller
• 'GOODS' means the goods (including any instalment of the goods or any parts for them) which the seller is to supply in accordance with these conditions
• 'SELLER' or 'WE' or 'US' or 'OUR' means Trance Plant Foods
• 'CONDITIONS' means the standard terms and conditions of sale set out in this document and (unless the context otherwise requires) includes any special terms and conditions agreed in writing between the buyer and the Seller or set out in the Quotation Order or Acceptance Forms issued by the Seller
• 'CONTRACT' means the contract for the purchase and sale of the Goods
• 'WRITING' includes telex, cable, e-mail, facsimile transmission and comparable means of communication

Any reference in these Conditions to any provision of a Statute shall be construed as a reference to that provision as amended, re-enacted or extended at that relevant time.

The headings in these Conditions are for convenience only and shall not affect their interpretation.

2 Updating Range

Our range of products is continually being revised and updated. We reserve the right to change specifications without prior notice.

3 Specifications

All descriptions, illustrations and sizes given in this website or catalogue are for guidance only and no particulars therein shall be binding on the company.

4 Samples

5 Price/Discounts

Trance Plant Foods reserve the right to alter any prices/discounts at any time without prior notice. Please refer to ordering information for details.

6 Minimum Order

There is no minimum order.

7 Delivery & Risk

Delivery lead-times are given in good faith and Trance Food Plants will not be responsible for any kind of delay in transit. We accept no liability and the buyer has no right to cancel the order if delivery is delayed beyond the estimated time unless we have specifically agreed in writing to deliver on a particular date.

Prior to dispatch great care is taken to inspect and package all goods. Upon signed receipt of a delivery, all goods must be examined as immediately as possible for damage or any items missing. Damage or shortages must be reported to us within 3 working days upon receipt of delivery. Failure to comply with any of the above will be deemed that the goods are acceptable and the buyer unconditionally waives any right to reject the aforementioned goods.

Our liability in respect of loss or damage to goods shall not exceed the invoice value of the goods (excluding VAT) and our liability shall in no event extend to consequential or indirect loss or damage, loss to third parties or loss of business.

The goods must be delivered to the delivery address agreed with Trance Food Limited. Under no circumstances should the carrier be instructed by the buyer to deliver to another address or to leave the goods elsewhere.

If the buyer, or a representative of the buyer is not available to check and take delivery of the goods at the delivery address, this may result in the carrier needing to return on another date and a delivery surcharge to the buyer may apply.

These are the terms and conditions under which tranceplantfoods.co.uk will supply the goods contained within this website to you.

By ordering from this website you are agreeing to our terms and conditions, these may be altered at our discretion at any time. All goods supplied are expressly not for human consumption neither are they warranted fit for any particular purpose but are supplied purely for research purposes.

Goods will only be supplied to persons over 18 years of age for their use alone and not for resale or use by anyone other person. The Company will not supply the goods nor make any refund if it suspects (on reasonable grounds) that such resale or transfer of the goods is intended. By ordering from us you are expressly confirming you are above the age of 18 and you are not purchasing for anyone under the age of 18.

All products sold on this site are done so strictly for plant feed use only. None of the products are sold for human consumption. The Company owner and employees cannot be held responsible for, and will not be held liable for the inaccuracy or application of any information or products whatsoever herein provided. In the event that any member of purechemicals.co.uk staff discovers or suspects a customer is misusing products sold by us, we reserve the right to terminate accounts without warning and deny any future orders. In this event any money paid will be immediately refunded

The company accepts no liability whatsoever for any misuse of any products sold on this site. Our products are sold for plant nutrition purposes only and are not intended for human or animal testing. We will not be liable for any direct or indirect damages arising from the misapplication or misuse of our products on humans, animals or other property. It is your responsibility to ensure that the goods are not used or applied in any manner so as to cause harm or damage to any property or person including yourself. The Company will not accept any liability for any consequences that may flow from the use of the goods or the failure on your part to take measures to prevent such use.

The Company does not warrant that the goods are not prohibited from import in the country to which delivery is to be made and will neither replace nor refund goods seized by any competent authority. It is the sole responsibility of the customer to establish the legality of possession and importation of our products in their country or region. We will not take responsibility for lost shipments confiscated by customs, law enforcement agencies, or other authorities, and we will not refund or replace orders that may have been confiscated. We do not ship any products to the USA, Australia, New Zealand, Israel or Sweden

The Company will not supply the goods nor make any refund if the goods are (or are reasonably suspected) to be delivered or intended to be reconsigned for delivery to The USA, Australia, New Zealand, Israel or Sweden, or to any other country where the possession and or use of the goods is either restricted or prohibited by any competent authority.

The Company will not be responsible for any loss or damage to the goods occurring in the postal system and will not make any refund in respect of such loss or damage except where specific delivery arrangements have been agreed and paid for in advance. On production of the necessary evidence the goods will be replaced but no refund made.

The Company reserves the right to alter these terms and conditions without notice at any time.
